Mother of all court battle

Matthew Aslett asked in Open Source Blog,“Are Microsoft and the FSF heading for the mother of all court battles?”

First question,  CAN this happens? We know Microsoft, despite the sable rattling, says it does not want to sue. So the implication is Microsoft can sue. The other part of the question, can FSF sues, is relatively easy to answer. First FSF can says it is being slandered and ask the court to get Microsoft to show its card, or FSF can takes its own patents and sue Microsoft.

Will this happen? My take is no. It is a MAD (Mutually Assured Destruction) for both side to take another to court. A lot of energy and money will be spent on both sides. All the dirty laundries on both side will be be washed in public. And in the end, both sides are worse off: bad reputations + give competitors the breathing room to compete with both parties.
